My girlfriend and I are going to be going through the PR application process, I will sponsor her. We are looking at our options and believe an Inland application is the better way to go for us.

Our question is, if she has to return to slovakia for what ever reason (family emergency) what is the likely hood that she can be denied by CBSA when re-entering Canada? We understand that if she is denied the application would be dead. Has anyone ever been denied re-entry while having an active application?

Chances are she will be allowed back into Canada. However we have seen some refusals here as well (they are few). No one here will be able to give you an actual likelihood as a percentage.

It wouldn't be 'dead', but the applicant must reside in Canada during the processing of the application. Short trips are tolerated, but if CBSA does deny entry, that could pose a problem. The CIC could deem the application abandoned and cancel it.

That said, my wife is from Russia, and we have also applied inland. Her grandmother is ageing and in failing health. We took the risk. An immigration lawyer told us before we filed that, it would be totally up to the CBSA officer if they would permit re-entry or not. If you can prove there is an active PR application, and the reason why she left, they may have compassion and permit re-entry.

Ultimately, no one here can answer the question of whether they would deny re-entry. But they can tell you if they have been denied before...
