I have recently received a refusal letter from Canadian High Commission UK for my application for permanent residence in Canada as a Federal Skilled Worker. I am now writing to inquire if there still is any chance for reversal of this decision through an appeal process.

From the contents of the letter I feel that it has been written in undue haste. My name is Muhammad Aftab Zaidi while the letter is addressed to some one named Majid Sana.This signifies that perhaps the application has not been properly scrutinized.

The application has been rejected on the grounds that the job description on the submitted JD does not conform to the duties which are performed by a Financial Manager. Moreover it further states that I have less then the full time required work experience in the designated occupation.

This is exactly what the letter says

"You have indicated that you have work experience in an occupation with the following NOC code NOC 0111 Financial Managers

Although the NOC code corrosponds to the occupations specified in the instructions, the main duties that you listed do not indicate that you performed the actions described in the lead statement for the occupation, as set out in the occupational descriptions of the NOC OR that you performed all of the essential duties and a substantial number of the main duties, as set out in the occupational descriptions of the NOC. I am therefore no satisfied that you are a NOC 0111 Financial Managers.

You have indicated that you have work experience in an occupation with the following NOC code NOC 0111 Financial Managers. Although the NOC corresponds to the occupations specified in the instructions, you do not have a minimum of one year continuous full time or equivalent part-time paid work experience in the occupation in the last 10 years"

Please note that the same job description was provided to Centralized Intake Office in Nova Scotia Canada and that office never had any qualms in accepting this case. However the application has now been declined by the Canadian High Commission United Kingdom on this basis. CHC-UK is the sole authority for examining all applications originating from Pakistan.

To say that I am disappointed would be any understatement. I am literally shocked, saddened and emotionally traumatized. I have waited exactly for 2 years. The initial application was lodged in April 2010. My English language proficiency is excellent as I had scored a maximum of 16 marks available under this head.

My agent has informed me that it has already written a reconsideration letter. The agent has taken the position that the decision is unjustifiable as it was initially accepted on the same terms by CIO Nova Scotia.

I would really appreciate if some one inform me about the availability of any recourse. I would also like to know if an appeal at this stage seems feasible since that is also an expensive proposition.

while I implore you to await advise from our seniors I will also want to beg you to put yourself together.

Firstly,the name is not yours,this should be your first point.

Secondly,i will like you to cross check your JD with that of HRDSC,okay?

On the other hand,until June 26 2010. CIC had no say as regards the posibility of the final determination as they were not the custodian of the full supporting documents.

Secondly the case was initiated in April 2010 and CIO approval was dated 30 June 2010. Later 120 days were given to submit all the necessary documentation to CHC- Uk

He performed the following duties:

The guys at CIC are well trained to suspect cases that are not straight forward.
 
i am not sure if they have I haven't asked my employer as yet since its been a while since I left that job

Dear all,
All those who got refusal, its important for you to know that "We got refusal letter
due to JD mismatch on 9th Mar through TCS, and we are being ready to appeal in the court
But yesterday on 13th April by an ordinary post we got a letter from LVO that
We rejected your file bacause you submit that before 2008, while we are refunding all the
fees as we have not worked on your file and........."

* We filed in 2010.
* In our ecas there is no processing date.
* Our Refusal letter donot contain date and even not our File no.
* Our representative (Lawyer) is now more hopeful to win.

***This is all just because I started tahajjud, salatul hajat and reciting ayatekarima all the time and expecting from Allah only..

Now our Lawyer will again write a letter to IO with the evidence that we are 2010 applicant not 2008's. She wrote request letter to reconsider, a week after getting Refusal.

Maybe some will get +ve hope from our case history..

Hi Aftabz,

Sorry about the rejection. The immigration officer had his reasons for rejecting your case as per not being able to proof that you had one year of continuous working experience in the NOC you applied. Two errors can be pointed out from your experience letter.

1. It is to certify that Mr Muhammad Aftab Zaidi S/o Zaighum Hussain Zaidi has worked with us from 13th May 2002 to 31St May 2008.
There was no place in the letter that stated if you were on full time or part time employment.

2.It is further added that he was getting a salary of Rs. 35,000.00 per month when he left the job.
The letter did not state how much you were earning when you were working with the company. It only stated how much you were getting when you left the job. IO might wonder why the company will be paying you when you were no more with them or is the wordings of the post or letter wrong?

This is what i can figure out from the letter you posted.
