I applied for my dad to come to Canada in 2019 and as you know with Covid, the processing time was long. My father finally got a reply back in 2023 from CIC with a a refusal letter and the reason was because he said he had never been refused a visa anywhere and this was a mistake. That same year my cousin was getting married in America and wanted some of the family members to come for the wedding. She asked for my dad’s passport and he gave it to her as she was applying for every family attending ,he was asked to do was go for an interview afterwards and in need his own words the US visa officer just gave him a piece of paper and there was no word in the document he received that said refusal since he barely attended to him. I haven’t seen my father in 17years and I fear he will be refused again, everything I’ve read online says to wait for 5 years.. that’s a long time for a mistake he did not see coming At this point I’m just looking to sponsor or get the super visa.. please help. I feel defeated.

So did he get a procedural fairness letter with the refusal of a possible 5 year ban? Didi he respond to the PFL within the time frame stated on the letter? If not, he is banned for 5 years and not eligible for any permit.

So you mean that he doesn't know that he was refused a visa after attending the interview? And he didn't tell you. Then you applied for him without putting down that he was refused a visa to US? This is consider mispresentation. (not stating the whole truth in the application)

Unless you are still within the period of appeal, he is ban from Canada for 5 years. He will not be able to get ANY type of visa (super visa, visitor visa or PGP PR sponsorship) until this 5 year ban period is over.

I think you should appeal if that's still possible. Or plan to visit him instead.

He wasn't banned. He is good to apply for a super visa now.

How do I appeal this, I just got the email last week.
