Hello,

I have a few questions I’m tirelessly tossing over my mind and riddling myself with anxiety over.

I was stopped by the police in 2018 for being drunk and disorderly, but upon arrest and search I had around 0.1 grams of a class A drug (cocaine) in my possession, for this I received a simple caution.

a year later in January and again very stupid (and still suffering with psychosis problems, depression and alcoholism) I was working in a care job with a vulnerable adult. I had no cash on me, so I took £4.77 from his money and purchased alcohol intending to put it back, before I was able to put it back however a manager became aware and alerted the police, I was fired and also had to sign a conditional caution with the police, the condition being I gave the person £4.77 back and wrote a letter of apology, to which I did.

A year has passed since the second caution, I have a very steady job, I am newly engaged, I have successfully sought out medical help (through anti depressants and anti psychotics) as well as attended AA meetings and not drank a single drop of alcohol since.

I received my ACRO police report for express entry purposes and it lists both of these cautions (both are spent cautions, no convictions)
Does anyone have any advice on any options I have? Me and my fiancée intended to emigrate to Canada ASAP, but it feels a little off atm, any ideas, advice etc...would be greatly appreciated! Thank you so much.
 
Are you inadmissible because of past criminal activity?
In general, temporary residents and applicants applying for permanent residence are considered to be criminally inadmissible if the person:
  • was convicted of an offence in Canada;
  • was convicted of an offence outside of Canada that is considered a crime in Canada; or
  • committed an act outside of Canada that is considered a crime under the laws of the country where it occurred and would be punishable under Canadian law.
The last one may apply to you.

A little speculative and short answer is that you are probably inadmissible to Canada as the possession of such drugs as heroin, cocaine etc is a crime in both UK and Canada.

The right answer would be to ask a lawyer.

yeah, i think you should consult a lawyer on such a matter. I don't think general people will be able to give you a good answer to this.
