Dear All,

As the rules have been changed and effective from 26th Jun-10, the changes will apply.

What about the application sent on 25th Jun-10 and received by CIO , NS after 26th June-10.

There will be many cases where application were sent on 25th Jun or before that and application received by CIO, NS after 26th.

Please share your opinions.

hi pareshvm

I think if it will be received after June 26, then it will be treated as an application received after June 26

I had observed that my CIO application in ecas was showing the received date as 17 March, even though DHL delivered the application on 15 th march.

I am extremely confuse. My application submitted on 24/06/2010 and received at the central office on 26/06/2010. Now the rules are changed, they are also asking for IELTS in advance now, so there will definitely be a break for them as we all go for IELTS and it is hard to get a date in next 4 weeks and another couple of weeks for result waiting. I want to say that the application numbers should have been dropped quite significantly. Will they give us any date to file the IELTS or return the application altogether???

I personally never heard before the date of receipt thing in such an important matter, it has always been the submission date.. They should consider the date of postage rather than the date of receiving application.

We have put loads of time in preparing the application and paid to the consultants as well.

I disagree with your comment. The applications should be accepted as date of received instead of posted. I can't imagine the office processing applications received on 25 of July which were sent before the 26 June deadline because of problems with the postal company for example. The more efficient way to set a deadline is against applications received and not posted.

Cheers

sometimes the post even gets delayed because of weekends, public holidays.

there is no way CIO can be checking the date of post (so many countries, number of courier comoanies etc), the only way they can control is date of received at their desk. Hence the rule would be for the date of receipt.

Yes it is real painful for people who dispatched the application in June and this got delivered on or after 26 June. I am not sure if they woud be flexible to consider, hope is very very little.

Any application posted to CIO on "X" date reaches there on X + 2 days then the applicable date will be the date when they enter it into the system which can be either X + 2 date or X + 3 date. Accordingly you can estimate the applicability of new rules.

Usually if an application reaches them on Wednesday then usually they stamp it as received maximum by Friday of the week so now you can estimate.

But if they can go by Postmark Date for "Investors, entrepreneurs and self-employed persons" they can do it fot FSW1

....... for Investors, entrepreneurs and self-employed persons class they are saying that....
"CIC has temporarily stopped accepting applications for the federal immigrant investor program. Only applications postmarked or received before June 26, 2010, will be processed. This pause will continue until certain regulatory amendments come into force later this year. Check this page for updates."
http://www.cic.gc.ca/english/immigrate/business/investors/index.asp

So it is not difficult for them to go by Postmark. All the applications posted before 26th june must be "signed and dated" before 26th june.
If they can do it for Investors class they can also do it for federal worker class ..... if they want to.............

In OP 6 http://www.cic.gc.ca/english/resources/manuals/op/op06-eng.pdf Page 17
"Applicants could not self screen before the Ministerial Instructions were made public"

Its an old manual (04-01-2010)...... waiting for updated version of OP 06
Bottom line............ total uncertainity........... we have to wait and see.

Dear aag,
It does make a lot of sense.
Before you send an application you couldn't possibly know about the changes. And once you send the papers you have no power to control it.

its been more than two weeks now, will wait and see. If I don't get my application back by the end of the month, I will contact my bank to check if the DD has been cashed or not.

I believe in this context - we can only keep our fingers crossed and wait if our application was recd before the June 26th... My application form for instance shows to have reached on the 23rd of June 2010. So even I am on the borderline... what more could we expect than the intervention of fate ?

We can do one more thing :) - pray to God.
Actually I don't understand how crossed fingers can help in any way :)
