Hey All!

Aussie Girl here, have been with my Canadian partner for 7 years, lived together in Canada for 4 of those years on 2 consecutive work permits, returned to Australia for 18 months and have come back to Canada on a visitors visa while we try and get my PR status.

Question being do we still qualify as a common law couple even though I went back Australia? I've been back in Canada for 4 months now. DO we have to apply as conjungal as we haven't currently lived together for more than a year?

Any advice greatly appreciated.
 
Conjugal is not an option for you under any circumstances. Conjugal only works in cases where there are real immigration barriers to getting married or becoming common law. As a Aussie / Canadian couple, you face no such barriers.

You can apply as common law provided you can prove you have in the past lived together for a full year continuously.
 
Do you think the fact that we lived together for 4 years previously would apply or would it only be from our current co-habitation period?

You can use the previous cohabitation, provided you can prove that the relationship was ongoing while you weren't living together.
