Hello everyone,

My name is Richard, and I have a conjugal partner and a son (1 yr. old) that are still in the Philippines.

We applied for conjugal sponsorship on July 2, 2015 (application submitted) then in September, Canadian Embassy in Manila emailed us saying that the sponsorship is approved.

Furthermore, they requested us to send additional documents, which are the NBI CLEARANCE and POLICE CLEARANCE OF MY WIFE FROM JAPAN, because she was previously married to a Japanese and she lived there for almost a year - separated. It took almost 3 months for us to receive the Police Clearance from Japan. We already submitted the required documents and was received by Ric Beronia on December 1, 2015.

MY QUESTION IS, WHAT IS GOING TO HAPPEN NEXT? ALSO, HOW LONG DOES THE BACKGROUND CHECK GOING TO TAKE?

Please help me...

Thank you,
Richard

HERE IS THE UPDATED STATUS SO FAR:

We received your application for permanent residence on July 2, 2015.
We sent you correspondence acknowledging receipt of your application(s) on September 17, 2015.
We started processing your application on September 7, 2015.
Medical results have been received.

Why did you apply as conjugal if you are married? Or you mean she is still married to former husband and she can't get a divorce?

All you can do is order notes to see where you are in the process (takes 30 days).

I'm sorry... I forgot to mention that we are not married yet because my wife's status in the Philippines is still married as the process for the annulment is taking too long; however, she is already divorced in Japan.

Thank you,

Richard

Thank you for this... How can I order notes? please?

Richard,

If your wife is legally divorced in Japan she does NOT need the annulment in the Philippines, unless you are planning to wed her there. In order for you to marry her, if that is your wish, you can both travel to a third country, if she is unable to get a visa for Canada and get married there under the laws of whichever country you choose.

I have read some of your previous posts and they are quite confusing. You stated your 'wife' was pregnant in January, then in May you said you had a 6 month old son, then you said she wasn't actually divorced in Japan because her relatives didn't file the paperwork as agreed.

If you want advise that will actually HELP you to get though this process, you're going to need to be sure you are very clear about the details. Applying conjugal may not work out to your advantage depending on the actual details behind your contradictory posts.

You should read this page regarding Filipino / Foreigner marriages. If her previous spouse was Japanese, these rules would apply to her: http://www.hg.org/article.asp?id=20090
