Hey,
It's me again. Just wondering , how many times do you have to be rejected for a resident visa to count as 'due to visa rejection they cannot live together' requirement? To be considered as conjugal partners that is. I will probably get mine but I was curious.
Also can I send the application while visiting in Canada ( within the six month time limit) or do I have to send from the states? I'm trying to figure this all out. Because I'd like to stay there as much as possible but want to know my options.
Thanks

Aren't you from the US? (Or maybe I'm mistaken?)

If so, then you don't need a TRV to visit. You're visa exempt.

I am from the US. I thought for up to six months ( or am I wrong?) then beyond that, we'd need a visa. I'd like to stay a year so he can sponsor me for a PR eventually and we want to live together. I wasn't sure.

You just apply for a visa extension that's all. The chances of getting it approved is actually rather high.

Ok. that's great news, but what exactly do I say to customs? As I've said in other topics here, I really don't want to lie as it's poor form, especially if I intend on becoming a Canadian eventually. I won't over stay, I will extend it through proper channels, as I won't dishonor me or my boyfriend and I don't want to fleece the Canadian government. As I feel allowing me to stay six months without a visa is very generous.

Why would you talk to customs to extend it? You apply online :) You tell them you want to apply as common-law PR and need to live together for a year in order to apply. And yes you can send it while you're in Canada. My husband has been here since May 2011 as a visitor :)

The US allows Canadians 6 months without a visa as well, thats why alot of couples do 6 months a year in each others countries and neither apply until they figure things out...

I wouldn't to extend, but when I drive into Canada at the start of the six months and they ask my purpose and how long I am staying. Do I tell them six months and I'm going to live with my boyfriend? I really don't want to lie for many reasons plus I'm planning to apply for common-law PR later, so shouldn't I leave an electronic trail stating as such?

Try to say that you're "visiting" your boyfriend, not that you'll be "living" with him. This helps show them that you know and intend to abide by the rules, and aren't just moving up there with no visa. Explain further as they ask for more information.

Also I'm pretty sure that what you tell the customs officer isn't actually recorded, just the fact that you entered.

Ok, makes sense as I always have stated before I was visiting which leads me to my next question. Is the six month limit consecutive or cumulative? All told, if you count the days I've been up there over the past year it totals about 3 months, but it's usually for a weekend at a time except once I stayed almost two months. If it's cumulative, I should probably file for an extension of stay soon then.

The visit period counts from the start of each visit, each visit starts a new allowance. If you visited before for 2 weeks, it was 2 weeks out of a possible 6 month allowance. If you are going back to visit, it restarts the clock on the six month period.

Thank God!!! Because our plan was for me go visit him next week per our usual ( we're both working) then two weeks later I was going up to stay for at least the winter. I Have a seasonal job) And I was worried I used most of my time up ( not too big of a deal as I could file an extension but I wanted to know if I needed it) but thank you! You made my day :D
