Can I sponsor my partner under Conjugal partner if she is applying in-land having the visitor visa?

if not married.....live together inside Canada for 12 months and sponsor as common law......otherwise marry and sponsor.

The definition of conjugal is not being able to get married/be common law because of immigration barriers. If you are both in Canada what are your barriers?
