Hey everyone,

I just wanted to know if there are stages to the PR visa for common-law.

When I went through the process for my PR in Australia, it was approved and then I was on a temporary PR visa for 2 years. I then had to send in a smaller application verifying we were still together, and then I became a full PR.

Is it similar for the Canadian process?

Cheers!

Similar yes, only you don't need to verify anything at the two year mark. The paperwork is likely more involved and time consuming than the Australian one, but can be done.

There is no subsequent application needed. Canadian PR is granted conditionally for the first two years if the common law status is less than two years old/no children in common (condition 51), but it is automatically lifted with no further application after that time. In addition, the Liberals had a campaign promise to get rid of it replaced with full PR with no waiting limit, and that appears to be coming soon.

Thanks very much for that!

So would this allow my partner to do any schooling / health care straight away?
When I was on the temporary for 2 years I wasn't allowed to do any schooling/training courses and wasn't eligible for Medicare.

We have been together for 7 years so we would have no conditional period?

Cheers :)

Depending on the province/territory, there may be a 3 month wait period before you are eligible for health care. Otherwise, that's it. You can go to school and pay resident fees.
If you've been common-law for at least 2 years, then you shouldn't have Condition 51.

Thank you so much for that! Very good to hear :)
