Good Day to all

My partner and I applied for commo-law sponsorship. We submitted our application on the December 16, 2020 and the office in Mississauga received it on December 17, 2020. My Post Graduation Work Permit expired on December 20, 2020. Am I still allowed to stay in Canada while I wait for our application? In our application we also included a Open Work Permit application. Also my partner is a Canadian, I don’t know if that matters.

Yes, you have implied status and can remain in Canada.

I called IRCC 2 days ago and one of the agent said that I’m currently out of status and that I should do a restoration within the 90 days. I have a friend that’s also going through the same thing and she said I am allowed to stay. I wanted to get a second opinion. Also, will I be getting a new SIN number?

The only issue will be if your application gets returned for any reason.

Sadly the help desk gives out wrong answers on a regular basis. They are pretty useless.

As long as you applied inland AND you included an OWP with your application package AND the application package reached IRCC before your PGWP expired - you have implied status.

Note that none of us here are lawyers. We are normal people like you.
