Hi,

I know there's a lot of info out there about this, but my situation is kind of "special".

So my girlfriend is a Canadian citizen. I'm a chilean citizen. We've been together for more than a year (as a long distance relationship). We started dating on february 2019. We met on july of 2019 and since then we've been travelling back and forth to each other's country. Specifically was like this:
- She came to Chile on july 2019, stayed 2 months and a half
- I went to Canada on december 2019, stayed 3 months
- We came back together on march 2020 to Chile, we've been here already 2 months

Now we're kinda stuck in here because of the virus. We wanna go back to Canada together (already bought tickets and got cancelled). So since I'm not a citizen I'm not allowed in there yet. We're trying to figure it out still, but anyways...

The thing is that, we're waiting till July to apply for common-law sponsorship (it's gonna be a year since we've been "living together", on the website it says if we were apart it was temporary or for a short period of time, which we actually did), the problem is that we don't have many papers to prove our relationship. When she comes here I rent a place to a friend (no contract, no papers, I just pay rent and that's it) and so does she, she rents a place to her grandparents, no papers, no contracts. We don't really have papers that show that we live together. I don't really know how to get more papers, or what kind of papers will work for proving our relationship. We can tons of photos, memory, celebtrations, etc but I don't think that will be enough. I know utilities bills with our names on it will work as well but I don't really know how to get that either since the places we live at are not our places, we just pay rent to the people.
Also we were thinking we could get married here, but we're not sure if that's gonna even help to get things faster or easier. We're really planning on getting married later on, but if it could help now it would be easier for us, we're just not sure if it would really help.

Now I also wanna apply for a PR or work permit or anything that works so I can go there and stay there with her until we can properly get our sponsorship. I read I can't really get a work permit unless I'm an international student or meet some criteria that I don't really qualify for it. I was thinking I can finish college there (I already started here and I'm half way through) so then I can become an international student and get a PR and also a work permit. But I work as a tattoo artist, I have no contracts, no degrees, we're independant workers, and since the virus lockdown started I haven't been able to make money, which makes everything more difficult. I may not be able to have enough money until next year. So I don't really know what to do right now, if anyone can help me, give me some advice or help on what to do first, or if anyone has been in the same situation it would be really helpful. Thank you.

P.S: Also I don't really know what's best for applying to sponsorship, outland, inland, since it takes some months and I don't get the PR I may have to extend my visa, etc. The thing is that we have to wait till July till we can finally apply to sponsorship (since it's gonna be 1 year living together)

1. One thing, you are not a common law couple. You met in July/19, spent 2.5 months, together, Were apart for 2 months or so, Now have been together since December, about 5 months, so you need another continuous 7 months of living together to be considered common/law.
2. 2.5 months separation to great a gap.

To add to the above poster, even if you did live together for a year continuously (which you did not) - if you do not have enough solid proofs from the very start of the 12 months to now, then it'll be impossible for you to get recognized as common-law. Your application will get rejected.

It is much easier for you to get married while in Chile and immigrate through spousal sponsorship.

Agreed with everything said above. You definitely are not common law and a common law application would have zero chance of succeeding. You are just dating right now and visiting each other. Being classified as common law requires you to actually live together continuously for a full year.

so you think getting married here in Chile and then doing sponsorship there is easier? we're really thinking about doing that. Also I know I have to do all the sponsorship paperwork to become a PR, but if we get married we officially become family members, even if I don't have a PR, right?

Definitely would make your lifes easier! You also wouldn't have to come up with as much specific hard proof of living together, just have to prove that it's a genuine marriage that was not entered into for immigration purposes. Correct, you would be considered family members.
