Hello everyone,

Here's a bit of a complicated situation. I'm wondering if anyone could shed some light on:

My common law partner (principal applicant from Germany) and I (sponsor, Canadian citizen) applied for inland spousal sponsorship and OWP at the end of December 2017. My partner's work permit expired also at the end of December 2017, and he is currently under implied status.

Recently our application was returned in the mail because his birth certificate was not translated from German.

- Does anyone know what this means for the OWP?
- Is he still eligible for OWP while we resubmit our sponsorship application with the translated document?
- Do we have to resubmit everything again, including OWP on top of the spousal sponsorship?
- Is he still under implied status?

Any help would be appreciated!

Thanks. We haven't heard back anything regarding the OWP yet. We sent it together, but only the spousal application documents were returned. Does this still mean the same?

It is a complicated situation.
The OWP is what give you implied status, so technically you may still be on implied status until you get notification of your OWP. However the OWP is linked to your PR app.

Was the OWP application not included in the app that was returned?? If not, then if you simply re-submit the PR app and include a note the OWP was applied for in your first app, they may be able to link them.

I am just guessing though, perhaps others have some actual experiences with this.

If your OWP app was also returned, then you'd be out of status so need to re-submit it along with a Restoration of Status application (you would have 90 days to do this from when you lost status).

It is very unusual that they would not also return the OWP. Typically, if one gets sent back, both get sent back. There is no way that they would continue to process the OWP because having a PR application in process is what makes one eligible to apply. With no PR app in process (due to it being sent back), that's why they send back the OWP as well.

I had my own PR returned (British Applicant and Canadian Sponsor) today because we hadn't supplied the correct proof of Income (We know what we missed) of my girlfriend who is my sponsor.
The OWP was not returned with the PR. I'm hopeful that the OWP is in process but I seriously doubt it.
I believe KBH is probably correct and that the OWP would not be processed since the PR process had not been initiated.

Now what to do?

- Resend PR application - tick
- Resend OWP application???

The OWP app is not being processed. It depends completely on having the inland PR app submitted. You need to re-submit it.

Do you still have valid status?

That's also what I thought. I've actually found the returned OWP in my pile of returned forms. It's with the original PR forms but its not in the accurate order I sent it in ;)
