Hello guys, i finished school in canada had a PGWP it expired then i am on a study permit now again that expires next June, now due to covid i’m not able to finish my study.

I got a job offered as a flooring installer in a construction company who is willing to apply for LMIA for me, knowing that i have NO experience in that kind of job.

Do you think i might be able to get a positive LMIA?

Thank you.

The employer may get a positive LMIA for the position if no Canadian or PR can be found. However your closed work permit may be rejected for no experience especially if a certified trade that requires apprenticeship training.

It's very hard to say. Basically the LMIA requires your employer to prove no Canadian could be hire for the role and that's why they had to hire you. Might be hard to get an LMIA approved and to show that if you have no work experience in the field (they could just as easily hire a Canadian with no experience). Same goes for the work permit. We've seen LMIAs sometimes be approved and then work permits refused.

If your employer is willing to go through the expense and trouble to give it a shot, then I don't see the hardm.

If you've stopped attending school, make sure that you convert your status to visitor so that you don't end up out of status (i.e. if your study permit is canceled since you've stopped attending school).

They’ve said i could work part-time for now then when i get to the point to apply for a work permit they will give prove that i was trained and worked part time.

I know the owner and he wants to help me to get that done and finally apply for permanent residence after.

You can certainly work for them part time now provided you stay in school full time.

Still hard to say if the LMIA will be approved given higher unemployment levels due to COVID-19. However again, your employer can always try. Make sure they follow the advertising instructions - this is very important to meet the requirements of the LMIA process.

Good luck.

It will be done through a lawyer, but its in a different city than my school so i can’t study and anyway due to covid i can’t study.
Does that mean i can’t work for them even part time?

You need to be in school full time if you want to be able to work part time (up to 20 hours per week).

So if you aren't studying then what is your status in Canada. If you dropped out of school then the school should have notified IRCC and cancelled your permit.
