Hi all!

I have a bit of a complicated case. I've applied as a refugee, but after waiting for almost two years for a hearing I've decided to be included in my spouse's PR application.

I want to apply for PR so I can visit my spouse's family (not in my country), but I can't leave Canada without knowing I will be able to come back.

The thing is, they will eventually ask for my passport, but the one I had was given to them two years ago and it expired anyway. I know that there have been some cases of people getting a new passport from their country and later on having problems with the hearing. I don't wanna drop my refugee claim until I know I'll get PR, so getting a new passport is the only way or should I just eplain my situation to them in the LOE without sending anything? Has anybody been in this situation?

I'd really appreciate the help!

Don't get a new passport from your home country. This is something that typically demonstrates your refugee claim isn't genuine.

Having a genuine claim that is never heard doesn't really help me either... As I said, I need to visit my spouse's family in a country other than mine, but I haven't been able to leave Canada for almost two years now. Don't get me wrong, I appreciate being safe, but sitting at the same place for that amount of time thinking that at any moment you could have a hearing that could go south depending on the mood of the officer hasn't been very healthy to me...

What about having your in-laws come to visit you in Canada?

It's not just about seeing them. It's about seeing other things, thinking about other things, having access to more than basic health care in case I fall ill for some reason, you know, normal life kind of stuff, something I haven't had for more than 5 years now since the reasons I became a refugee claimant brought me here... Anyway, I appreciate the help guys, but I know there are some people who either got sponsored or got included in somebody else's pr, so I just wanna know how they dealt with the passport issue..

You're a refugee from a country you really want to go back and visit?

I thought the whole point of being a refugee was to get away from your home country at all costs?

Read my first post. Where does it say I want to visit my country?

I apologise.

At the moment though you do appear to be a bit stuck.

I would seek legal advice on this one so you don't step wrongly.

Thank you, I've already started doing that. Just thought somebody here would have gone through the same thing, since I've read about people waiting for a hearing for over 5 years.

Refugees do want to return home but to a safe home not if the hostility continues.

Thanks, but in my case I don't really wanna go back, it's still too dangerous for me. Just wanted to get my PR so I could go somewhere else for a month or two and not sit thinking that at any moment I could be sent back to die. Anyway, I really thought somebody here would have had the same experience with express entry. I got in contact with my lawyer, but he alway takes sometime to reply, so I guess I have no choice but to wait and hear his point of view.
