Shortly, if I am staying with my parents, I mean with my "mom" and with her husband, in the United States, and we are here international students, me and my husband, and we applied at Buffalo visa office, and we want to go back to our home country, Romania, due to some personal "misunderstanding" and we want to leave the country(USA), can we transfer our complete file, our complete documents to our home country, Romania? We have sent our complete file to Buffalo at 26 August 2010, but we haven't got any response or the second AOR yet.It is possible, in case we leave US to transfer our file to visa office Bucharest? Just a thought, guys help!

Hi,

YES it is possible you will need to write a letter to the visa office requesting them to transfer your will to your home country visa office as you are permanently moving out from US and they will transfer it for you.

yes u can change visa office....but the problem is again in new office they will start from step1. anyway u did not get file number....so no matter of time taking

No you can't transfer you application, here is what CIC regulations state.

Visa offices are not required to transfer files for any other reasons. Such reasons include cases of applicants who comply with subsection R11(1) for the specified visa office, at the time the application is received at the CIO, but subsequently leave the territory of the specified visa office. In these cases, the original visa office should proceed with a final determination of eligibility and process the application if eligible. The visa office should not transfer the file to another visa office unless the transfer is warranted for program integrity reasons. Leaving a visa office’s territory alone does not warrant a file transfer.

While there is an option for the CIC to transfer file based on "Program Integrity", the applicant does not have any such rights or provision.

Now if you check the following link (point 5), you may get some hope of transferring your file, but again this is based on the discretion of VO and without compromising the "Program integrity" of the CIC rules.

Micuza, if you have already planned to leave your current territory of VO or have no other option but to leave, then you will have to inform your VO for sure. The situation which might be in your favor in this scenario is that your your student visa can no longer be extended and you will have to leave the country. You may mention this in your requset to transfer your file,though there is no gurantee for a positive outcome. But there is no harm in giving it a try. I had read one post a long time back wherein, the applicant had declared bankruptcy as a reason and thus could not continue to live in USA.

NB: You have to intimate VO if you are moving so that they can post your 2nd AOR to your current address.
