I have significant family ties in Canada. My mother is a Canadian citizen and resides with me in Canada. In addition, I have two sisters and two brothers who are all Canadian citizens and permanently settled in Canada. One of my elder sons, aged 19, has autism and requires stability, continuity of care, and a supportive environment. He is currently receiving support and services in Canada. Relocating him would significantly disrupt his care, education, and overall well-being and would cause severe hardship to him and our family.

Furthermore, I am actively involved in my local community and have built strong social and community connections in Canada. I have demonstrated genuine establishment through my work, family life, and community participation.

Considering the totality of my circumstances—my strong family ties in Canada, my children’s long-term establishment in the Canadian education system, my lawful employment history, my son’s special needs, and my community involvement—I respectfully submit that my case meets the objectives and spirit of Humanitarian and Compassionate considerations.

Also my daughter is permanent residence of Canada.

What are the chances for success for H&C application?

Honestly, it's impossible to say these days, with changing quotas and legislation. All you can do is apply and hope for the best.

What are the chances for success for H&C application?
Apply and wait. Processing is more than 10 years so your work permit will probably expire at some point so you will not have access to health care or social services. Is 19 year old PR or citizen because if not he would need to apply too.

What are the chances for success for H&C application?

Do you not qualify for any economic pathway? What is your age, educational background, what NOC do you work in, what province do you live in, what are you language scores, do you speak French, etc.? What is your citizenship? When does your WP expire? Is your employer willing to try to help you secure a WP? Assume you have looked into your realistic chances of being able to secure a WP like unemployment rate, whether your salary/hourly wage, etc. would allow you to qualify for a WP. If you aren’t able to secure a WP the big issue is that you will lose your status before your H&C case is processed. Processing time is decades these days and there is very high chance the program will go through some significant reforms (general H&C may be even be cancelled and may be restarted with much more strict criteria) likely after bill c-12 passes. Attempting to remain in Canada without status is not advisable but you and some of your children will also run into issues like accessing healthcare, education, etc. when you run out of status. Your ability to support your family without a WP will also likely be an issue. How old are your non-citizen children? The very long processing time will impact your children in different ways. I would speak to a lawyer about your potential options. The best option would be to secure PR via an economic pathway and not H&C. I would also be monitoring the news/IRCC about bill c-12 and any announcement about changes to H&C programs after bill c-12 is passed.

With HC applications taking 10 years , then what ?
You’re sounding like an application would only take a couple years . The 19 year would be pushing 30.
You wouldn’t have access to any services . How would you support your brood? Those services the 19 year is accessing would be inaccessible.
And everything you described was a choice you made . You chose to bring the children to Canada and “ integrate,” it wasn’t forced upon you.
And kids can easily adapt at a young age . But once again this was a choice , you as the adult made.
You made Canada as you put it there primary home , all the while you were or are on a temporary work permit.
Knowing full well you’d have to leave one day .
This is why Canada is implementing bill C-12 to stop frivolous claims such as this.
It’s irrelevant all your relatives are here .

You should be looking at an economic stream .
