Hi guys,

So my work permit was expiring on November 2019 and at that time I hadn't received my ITA from CIC. I spoke to a lawyer who advised that I quickly enroll in a program and apply to extend my stay as a student which would give me implied status and therefore allow me to stay in Canada and apply for my PR when I receive ITA. So I applied for my PR in November and received my ITA and applied for my PR in December. If my study permit is refused, do I have to leave and simply provide CIC with my address back home?
 
I think you can apply to restore your status as a visitor if your study permit is refused. Usually, when that happens, they give you some time to leave the country. What I don't understand is why you are not applying for a bridge open work permit. Is that because you got ITA after your work permit expired? I will let the experts help you.

Correct, I was not able to apply to bridge because I received my ITA after my work permit expired. I'm wondering If I can leave to my home country and wait for my PR to get processed and then request for the landing visa to be transferred to my local visa office which is Accra?

I do believe there is an option to submit your passport to the visa office in your home country when your PR status changes to PPR. PPRs are virtually approvals and once you get the request, you can request the file to be transferred to the visa office in your country by submitting a webform. I have seen quite a few forum members talking about this. I wish you good luck with your PR application.

Thank you so much!! I don't want to do the restoration because if I get the PPR and I send my passport and it's returned to me while I'm in Toronto, I fear that I may face some issues at the border when I'm landing seeing as I would be out of status if I'm waiting for restoration. Do you know anyone who has been in a similar situation? @indianstudent96

Of course you have to leave, and inform your change of address to IRCC. They'll then based on your information direct your file to where it should be processed. Or else when it's approved the corresponding office will contact you for you to submit your passport.

Thank you for your response. I will wait, hopefully once they request for my passport, I will inform them of my new address and request for the file transfer to home VO for landing visa.

You don't need to request your file to be transferred anywhere, all you have to do is inform them about your address change. That's it.

They'll do anything they need to based on this.
