Hello All,

I was searching for the forum like this to gain more knowledge about whole spousal immigration process and see what I can do to solve the issue that I am facing.
I am sure that some of you folks can shed me some light on this issue.

Here is the story,
As I got married, I applied my wife's immigration application about 2 years ago through an immigration agency (Lawyer's Office)
The waiting period was very painful as my wife and I could not go anywhere else other than few different cities in Canada (In-Land Application)

After a long waiting, our status finally was changed to "Decision Made" on the CIC website, yet, we have not received any letter from the CIC office or from the agency.

Unfortunately, when I checked the status yesterday just to see where we are at, the status has been changed to "CANCELLED"
My hands were shaking and I was literally speechless and clueless.
I tried to wrap my head around, and called CIC.
They explained that my wife's whole application is cancelled due to a "No-Show" for an interview on February, 2016, which I did not know about. Again, no letter was received either from CIC or the Lawyer's office.

I called to the lawyer's office and told them about whole this "cancellation" situation and they told me that they will try to see what they can do.
In a worst case scenario, I may have to start a new case all over again, they said.

Is there any way that I can re-start my wife's case?
Is there any way that I can shorten the process time?

Any help on this matter will be much appreciated as I am literally clueless on what to do.

Your lawyer failed to advise you about any documents that he/she received on your behalf, and they WOULD receive them because they were your 'representative'. Your wife was apparently approved and invited to her landing interview back in February and your lawyer wont be able to do anything about this. It is likely that CIC will advise you to fill out a new application. Sadly, it won't go any faster than 'normal' but I would really advise you to fill out the forms yourself and not use this lawyer again...
 
It may or may not help at this point, but if I were you I would go to your MP's office and explain the situation and ask them to contact CIC on your behalf. I don't know if they can convince CIC to reschedule her landing appointment... but it doesn't hurt to try, because you have nothing to lose now.

Find out where your MP's office is, call them and make an appointment, or just go. Don't email them and wait for a response. The more time passes, the less chances you may have. Good luck!

I agree; it can't hurt.

Since there is an expiry date on the COPR, as long as that date has not yet passed, perhaps the MP can convince CIC to re-open your file.

I am not sure what would be the expiry date for this case.
However, the CIC agent that I talked to said that the interview was set up on Feb and the case is cancelled about a month ago.

Hope I can get some help from the MP.

The expiry date is usually the one year anniversary date of the medical exam.

Has it been exactly one year (or more)?

IT was done May 2015.

Thank god, still have little more dates left.

Definitely talk to your MP. Some are very helpful, and in any case it won't hurt.
I think you should also report your lawyer to the Law Society in your province. It is possible he did not get notification of the interview, but more likely it was misplaced or ignored.
 
If you report the lawyer to the Law Society, you can also ask the society to order the lawyer to refund you the fees you paid him. If they won't, you could also take the lawyer to Small Claims Court.
