Hi. I would like to know if it's possible to cancel a PR status. A friend of mine sponsored her husband and daughter after 6 months of arriving to Canada. After her husband and daughter arrived in Canada, her husband said that he doesn't like to stay here in Canada and wants to work instead to another country as a foreign worker so they could save faster to be able to get them their own house. So she let him leave and every year he would visit my friend and their daughter. Then she later found out that he has another woman and have been living together for several years in another country. They're divorced now. And now her ex-husband wants to stay in Canada so he could sponsor the other woman. She also found out that before she sponsored her husband and daughter, her husband was already seeing this other woman. He just waited for my friend to sponsor him so they could later move to Canada. Can my friend still request to have his PR status cancelled? My friend really needs help. Thanks
 
No. However, he might not be able to fulfil the Residency Obligations if he has only been back to Canada for short periods. Who knows, maybe he has already put himself into a difficult position. There is not enough information provided to guess really.
 
Did she actually sponsor them, that is she was PR or citizen and she applied to sponsor them separately or did she apply for PR and include them on her application as her family members?

If she sponsored him, he can not sponsor another spouse until he has been a PR for at least 5 years. If he has been outside Canada for years coming back for short visits only, he will not be able to sponsor his new spouse because he doesn't meet the residency requirements.
 
My friend came to Canada November of 2002. She was able to sponsor her husband and daughter after 6 months and they arrived in Canada January of 2004. He only stayed in Canada for few months and left for another country to work. He comes and visit them at least once a year and keeps renewing his PR status before it expires. They got divorced late last year. And now she found out about his plan to stay in Canada for good so he could sponsor this other woman.
 
CIC might be interested if the ex-husband is lying about his residency dates so that he could get his PR card renewed, but that's about it. It's all far too long ago now. She should move on with her life and forget about him.
 
So if he got his PR in 2004, his first PR card would have expired in 2009. If he only came to Canada to visit, he would not have met the residency requirements and still managed to renew his PR card somehow. Now that it's 2013, he's already outside Canada 4 years on his new PR card. This guy is really depending on his good luck.

She can report him to CIC. It may not be considered a marriage fraud because they have a child together and they were married for several years after he got his PR even though he was cheating. However, CIC may put a note on his file to check him out when he applies to sponsor this lady and/or when he applies to renew his PR card. However, there are no guarantees that he will lose his PR.
