Hello all, I have been scouring the forms here but have not really come across anything similar to our situation.

I am a Canadian citizen, born and raised. Ended up coming down to the United States in Aug 2018 for what I thought was another visit with my long distance boyfriend. He proposed, I stayed and we got married. I am a permanent resident here, but am miserable in the States.

We have lived together since Aug 2018, got married Dec 8 2018 and now I want to go home (he needs to come with me!)

I saw that there is a minimum income requirement to sponsor a spouse $25k, which I sadly have not met for the past 4 years due to being self employed. Is there a way to sponsor him still? My mom is willing to co sponsor, but from what I read that isn't a thing?

He also has a criminal record from Feb 2011, it was originally a felony and he did some time in jail, but it got dropped to a misdemeanor a couple years ago. He had no issues at the border when he came to Canada to visit with his passport - so I am not sure this would affect him moving with me to Canada?

Any tips or suggestions / directions on how to go about this would be greatly appreciated. I want to go home! :)

There is no minimum income requirement. You need to show how you will support yourselves in Canada without welfare. Your mother cannot co-sponsor but can write a letter of financial support.

His criminal record will be equated with criminal law in Canada. Depending on what it was for, he may be criminally inadmissible and require Rehabilitation. What was the conviction and when did he complete his sentence (including any probation)?

Everywhere I was looking online said $25k, we have no kids so hopefully that makes it easier, I also have savings and a home in BC and a job as soon as I get back!

His charge was for a hit and run, he completed his sentence in 2012 and probation in 2014. He did 3.5 months in jail and was put into the working dorms, (where the non violent people are put) He was young and dumb when this incident happened. He did come up to visit me in Canada in 2018 and didn't have any issues crossing with his passport so that was a relief.

  • you’re sponsoring a dependent child that has 1 or more dependent children of their own, or
  • you’re sponsoring a spouse or partner that has a dependent child, and their dependent child has 1 or more children of their own.
