Hi All,

Currently we are on closed work permit. We will be applying for PR next year Feburary and I am aware that if a child in born in Canada, parents staus won't change.

What are the options avaialble in case our work permit expires & our PR process still in progress.

Can we apply for temporary work permit (not with current employer) or do we have to return back & wait till PR is processed. Or is there any other temporary option.

Best Regards,

You don't even have to mention the possibility of a child because as you say, there is no change in your status if you have a child.

If you have applied for PR and you have gotten first stage approval, you should check if you qualify to apply for an bridging open work permit, see http://www.cic.gc.ca/english/work/permit/extend/permanent.asp

If not, you should ask your employer to apply for a new LMO for you, 4 months before your work permit expires. If they get it, you can apply to extend your work permit. If they don't get it, you would not have much time to find another job and ask another employer to apply for an LMO.

If you are able to apply for a new work permit or to extend before your current permit expires, you are under implied status and may continue working until you get your answer from immigration. If you are unable to apply and your work permit expires, you must stop working. You then have a 90 day grace period to either restore your status or leave. You also have the option of applying to change your status to visit before your work permit expires and therefore pay the fees for a visit visa rather than the higher fee for restoration.
