Hi Sir/Madam. I am a TFW in Alberta. Been working for 5 years now in Canada. I am aware that we have a 4 year limit of stay of TFW's if we haven't been processing our status for PR yet. I have a 5 month old baby and his father is a canadian, and we're living together as common law. We can't marry yet as I am still married in my country. The annulment process will take 6 months to 2 years. I am waiting for my LMO with the same employer of 3 years, and if it is denied (i am updated on the changes for obtaining LMO's) i know i have other options of finding a new employer and has 90 days left allowing me to stay in Canada. If ever, i get unlucky with any situation. i know that i have to go and leave the country. What will happen to our baby? My partner of course won't like that to happen. We can't just leave the baby to anybody or anywhere. We want to stay together as family. Whats the best advice you could give us? Thanks in advance.
 
If you are really common law (i.e. if you and the father of your child have lived together for at least 12 months) - then the father of your child can sponsor you for PR. You don't have to wait until you are divorced.
 
Look into the Alberta nominee program. (Alberta work experience category). If you are eligible you can nominate yourself and apply for PR without the help of your employer. I am not sure if you are eligible. I think you have to have a valid work permit at the time of the application. So if it is expiring soon, you have to work on this as soon as possible.

If you apply and receive eligibility (First phase approval). You can apply for an open work permit.
