I am an Indian citizen, currently residing in US for the past 5years in work visa. I applied for Express entry along with my spouse (My husband was the primary applicant and I was the secondary applicant). We recently got picked up in Canada PR lottery invitation. Unfortunately, last year my husband had DWAI. I wanted to know, if there will be any problem proceeding with the immigration proceedings because of this. Please advise.
 
Drunk driving is a criminal offense in Canada...very serious and wrong. Depends on his charges, was he charged, pled guilty and blood alcohol level. He may be inadmissible to Canada.

It's a DWAI not a DUI so BAC was under 0.08. He may be ok.

He was charged but after court hearing he was given with DWAI.
 
From what i've read, a DWAI may count as criminal inadmissibility to enter Canada.

That's because there no matching DWAI charge in Canada, so the closest charge is a DUI, which makes you criminally inadmissible.

I think you need to get advice from an immigration lawyer, this is above our pay grade.

A DWAI will show up on a state background check.
