I have a question-

On what basis can we enter into Canada if we have US H1B Visa and also working in the US?

Also, what if the person who is on H1B in the US wants to get married in Canada to a canadian PR, will that be an easy transition?

Any help is highly appreciated!!

The fact that you have an H1B visa is irrelevant for your travel to Canada.

If you are not from a visa-exempt country, you need a visa to travel to Canada. Only US green card holders are exempt from this requirement.

Your H1B status is also irrelevant for your marriage plans. You can marry a Canadian and that person is then able to subsequently sponsor you for PR (provided the marriage is genuine and not entered into for immigration purposes). But this is true for everyone - it doesn't matter that you have an H1B.

Bottom line: your H1B does not make it easier for you to travel to Canada or to immigrate to Canada.

Because, if marriage happens out of Canada in India then it will take minimum of 12-18 months to get the spouse as PR status, correct me if I am wrong.

And, if we apply for a travel visa and plan to get married in Canada will be a misrepresentation, right?

I don't see why it should make a difference where you get married. Could be anywhere really.

It will always take the same amount of time for family sponsorship.

There's nothing stopping you from using a Canadian visitor's visa to get married there. But you have to leave again before your visa expires.

You might be able to subsequently apply for a temporary visa so you can go and live in Canada with your spouse.

I'm no expert on this though. You should read up on this in the family section of this forum. That's also the better place to ask these types of questions.
