Hi,
I have one contract valid for 24 months, the employer in 5 months ago never contact me to start to work, I have to found other company to work and this new company are allow to transfer my contrat from the first company that gave me the work permit.
However the first company (that one that gave me the work permit) contact me today and told me if I don't start Monday with them they cancel the contract.
How this works? I have time to say to first one that I don't go with them and can I continue work with the new company until the the transfer of the contract would be proceed?
How long take until the first employer cancel my contrat?

are you working under the FSW program? if the first company applied for an LMO for your contract, the second company can't just take over that contract. I would imagine the second company needs to apply for a separate LMO and get approved.

We are under work permit contract!

But we don't know if the first company can cancel right away the contract and don't wait for transfer!
Thanks

i understand you are under a work permit contract. the question is how did you get the job? did you have an open work permit, and then get the job. or did you get the job and then get a closed work permit. it makes a difference i would imagine.

for example, if you were offered the job, and then went through immigration to get the work permit, i really don't think employers can just trade contracts like that without being authorized by CIC.

now if you're simply asking how long it takes for the first company to cancel your work permit so you are free to apply with another company, i am not sure how long that process takes. i would imagine it doesn't take long at all.

From my understanding if you are not holding an open work permit, once company #1 cancels your contract under a closed work permit, you will not be able to work for company #2 until they are approved to hire you under a new work permit. if you are working for company #2 before you are legally authorized to by CIC, you are working illegally and in jeopardy of being deported. i also believe you will essentially lose your legal status in canada until company #2 is approved to hire you under a work permit, so if you remain in canada during that time, you will be there illegally. You may be able to switch your status to visitor to wait out the new application for a work permit for company #2. Visitors can NOT work or go to school while in Canada.

Now perhaps my understanding is wrong, and a more senior member can tell you for sure.

the real questions are what kind of work permit do you have and who is telling you that you can just switch employers and transfer the work permit without authorization from CIC?
