Hello, I am having a very hard time making the decision of what is the best route to take as me and my Husband have just got married and have been in a relationship for a year now. I have been living in morocco for 2 years and we met and fell in love a year ago.. with us doing our marriage paper work now (engaged for 6 months).
I just don't know what to do as i do not want to leave him esp. in our first year of marriage but do not want to be denied as i really want to go back to Canada. so it seems like there are only 2 likely options
1) me go back to Canada and apply from there and he stays in Morocco ....which my understanding could be 1-2 years with me only being able to leave Canada for 2 weeks each trip?
2) me stay in morocco, work, and then attempt to find a place that will give me a job offer a year away or apply for a school option for the next year and apply from here?

3) seems far fetched... me go home, apply, then apply for him to get a visitor visa (which 1 was denied when we were dating last year) and then have him try to do the paper work to be able to stay in Canada while we are waiting or apply for a visitor visa now and then apply inland

i just feel so lost.... i just want to do the thing that will give us the best chance of going home but i also want to be with my husband and not be separated for long periods of time.
please give me some advice of what is the best route to take!!!!!!!
 
You really have two options. Both of which you apply outland. You can apply outland and stay in Morocco while paperwork is in process. However you must provide proof that you will move back to Canada when your spouse gets PR.

You can move back to Canada and submit an outland sponsorship. However as a Canadian you are not required to remain in Canada during processing. You can come and go to Morocco while papers are in process.

You can apply inland but in order to do that, both you and your spouse both must be inside Canada. So until you and your spouse is in Canada, inland is not an option for you.

1) what do you think is the best option for success?

2)for me moving back and submitting a out land that just means he is living outside correct? and to your knowledge there is no limit to me traveling as i read some wheres else that the visa can be rejected if CIC see's that you are traveling too much and they deem that as not "living" in Canada.

1) There is no best option for success. Outland application timeline will remain the same whether you stayed in Morocco or Canada. Processing time for Morocco is about 9 months.

2) That is not true. As long as you maintain your residency in Canada, it doesn't matter how many times you have left Canada. However if you left Canada longer than 6 months total (doesnt have to be consecutive) in a year, you are deemed a non-resident of Canada. This is when it becomes a problem. While CIC will not void the application but it may delay the process since they will then ask for proof of you returning to Canada to stay for good. If CIC is not satisfied or convinced that you will return to Canada, they can void the application and tell you to apply when you are, in fact, ready to settle in Canada.
