I want to ask this on behalf of someone who got their spousal sponsorship application rejected after waiting for almost 3 years. He also has a child now but said he does not know why it got rejected
 
Yes. Reasons like an ineligible sponsor (certain criminal convictions, bankruptcy, previous sponsorship default etc.) or an inadmissible applicant (criminal record, misrepresentation etc.) can definitely lead to a refusal without an interview.

Your friend should have received a refusal letter outlining the reasons. He should also request his GCMS notes to get a more in depth look.
 
or, an application can be rejected without an interview if the applicant or sponsor neglected to respond to a request from CIC within a specific amount of time. It doesn't matter if the communication wasn't "received". If they sent a request, and it wasn't complied with, they have the right to make a decision based on the information they have.
 
I got a notice saying that if I didn't send them a document by such and such a date they may or may not refuse me based upon the lack of said document plus I was technically refused based on two missing signatures but I signed them and resent it without paying the fees again as they stated I could. Neither time was an interview mentioned.
 
The one place where they won't reject your application without an interview is if they doubt the validity of your relationship. They will always have an interview first before rejecting on those grounds.

Otherwise they can certainly reject the application without an interview for other circumstances.
 
I believe the case got rejected because of Social Assistance. He was not on Welfare but recently (11 months ago) got a house (social housing). Does Social Housing count as social assistance and therefore have your application rejected?

usually when you are living in community (or social) housing, the government is supplementing your expenses somehow. which means the GOVERNMENT, not the person, is paying all or some of rent and utility bills. so yes, i believe that is the same as social welfare. CIC has every right to reject that application. if the sponsor wants to bring family over, then they need to pay for their own housing and expenses, without the assistance of the Canadian government.
 
It makes sense in a way as the sponsor is supposed to support them so they don't use social assistance because if they do, the sponsor must pay the government back. However, if the sponsor is on social assistance, he or she is supporting the applicant with the social assistance. So technically the applicant becomes on social assistance because, at least in the states, the amount received is dependent upon how many people in your household so the allotment increases accordingly. That could be how the officer sees the situation as well.
