Can somebody apply for close work permit while having 4 years open work permit?

Hi guys,

Can somebody apply close work permit (through LMIA) if he has an open work permit almost for 4 years? That person has a job from april, 2016 but has an open work permit from 2013 april.
Is it possible or not because the 4 years limit?

Did you work for 4 years on open work permit or you just had it without using it all the time?
I guess only the periods that you have worked would count.

I am not 100% sure, though.

I have not worked for 4 years, only 1.

My other question is, can somebody apply for an open work permit, as a spouse, after having a 4 year close work permit? (that person worked for 4 years.)
