Hi,

I would like to discuss regarding my brothers PR status.
Actually my brother took PR in 2008 and at that time while completing the PR formalities he landed in Toronto, Canada from US. And after 1-2 weeks he went back to US.
Now its almost 3 years and his PR is going to expire as after that he was never able to visit Canada.

Now question is this that if he want to continue his PR status without landing or visiting Canada at this stage, would it be possible.

Also as after going back to US he was not able to collect his PR Cards from Canada. They are still here in Canada with any of his friend. He decided just not to receive them through postal for safety purpose. So officially he only have his landing papers.

He has gud job in US and dont want to leave it but side by side he would like to keep his Canada PR status ON.

Is there any way, he can do something from US only without visiting Canada so that his PR status can be renewed.

In order to maintain your PR status you have to live in Canada for 2 years out of a 5 year period. There are some exceptions to the rule I think if you are the caregiver for a Canadian citizen abroad or your working for a Canada company abroad. Looks like if he is not willing to move to Canada he will lose his PR status.

He can't renew his PR card from the US (he must be in Canada). And as Wolvy said, he must live in Canada two out of every five rolling years to maintain PR status.

In addition to the exceptions mentioned by Wolvy, if you are a PR who is living outside of Canada with your Canadian citizen spouse - this also allows you to retain your PR status without physically living in Canada.

If your brother does not meet any of these exceptions, then to retain his PR status, he would have to move to Canada and live in Canada (likely without leaving) for the next two years. If he's not willing to move, then he should probably say goodbye to his PR status.

This means that even if I get my visa this year and enter Canada next year before expiration of my medical reports. I get 5 years from there to maintain my PR where in I need to spend 2 years out of those five years. Correct me if I am wrong in below mentioned:

I get my visa in 2011 (Say July 2011- Assume my medical date is also July 2011).
I enter Canada before July 2012 before expiration of medical and comes back after doing landing formalities.
Do not enter Canada till June 2015.
Decides to go to Canada before July 2015 and says there till July 2017.
My PR will be valid and will be renewed.

Please clarify.

Yes. From the date of landing you have to stay in Canada for 730 days over a five year period.

Yes - but you wouldn't be able to leave Canada between July 2015 and July 2017.

Yes. I would be better if I keep few months with me in case I need to travel out of Canada for emergency etc.

Also, If you all seniors can suggest me based on my above post when will I be able to qualify for citizenship (Which Year).

Nothing beats the bit of reasearch on your end...it will go a long way... try Citizenship on www.cic.gc.ca

I have one question regarding this - something I have always wondered about, is that how do you prove you have spent 730 days in Canada during the preceeding 5 years? Do they examine your passport stamps or look at their own customs records? Presumably there is some kind of form similar to "Your Travels" for immigration where you have to declare all the time spent outside the country?

Is it a good idea to keep copies of air flight tickets etc?

yup i thought that too. and i guess you should keep everything original u can and get copies of other papers which can be useful later on........

You will qualify to apply for citizenship once you have physically lived in Canada for three out of the last four years.
