Can my wife file for me while am living in Canada or I have to be out of Canada?

I am from Luxembourg. We wanted to spend all our time with each other. To file the sponsorship, must I be outside of Canada or inside of Canada? Can I do it while being with her in Canada? I understand to file the paper work would be at the Paris Embassy, and this would take 8 months. And we wanted to be with each other cause 8 months is a lot of time!

you can file outland application while inside Canada or inland application,inland is a little bit longer but after 1st stage approval you can file OWP..but if outland is only 8 months then go do it..

Hey D,

you should file outland, it will be faster for you for sure.
If your wife is a Canadian citizen, she can file from inside or outside of Canada, no worries. If she is a PR, she must remain inside Canada.
For you, you can choose to be outside, or inside, but if you are in Canada, you will be on a tourist visa - you won't be able to work, have healthcare etc, but you can be in canada, as you are from a visa exempt country. you would need to keep on extending your visitor visa, but you can be given up to 12 months at a time, and so it should cover the PR issuance. It's always up to the border officer how long they will give you and if they let you in the country, but it should not be a problem - if you decide on that option, there are a few things to consider, but not many. You can also extend your visa once in Canada.

AS for timing: first stage is 66 days ( approval of sponsorship), and second stage in Paris is average 8 months, but quite a few get done before that. So you might be lucky and get your PR before that.

You need to send your application to Mississauga first, and they will forward it to paris once they have assessed the first stage (sponsorship approval) - see Leon's first post about the advantages of inland and outland.

Also - important to mention: if you apply inland, you can not leave the country during the process. if you apply outland, you can.

I don't want to stay inland and wait there 20 some months to get a working visa or wait and hope and pray for them to extend my visa for 12 months or 1 year because I am married! Chances are they might not even approve my visa and then I need to get a flight back and so on. So I think waiting out the 5 months is way better then to deal with all that stress!

I had read one lady whos husband was from Portugal got it done in 4 months and 28 days. So about 5 months but they say 8 months total for everything I guess.
