This forum had been a great help for me in many situations! Hoping that the people with expertise can help me again in guiding me in right direction.

Here are the list of events that took place.

1. I met a girl when I went to India in May 2014.
2. As we were interested in each other, we have been talking to each other on phone and skype since June 2014.
3. Her dad had applied for a business Visa in October 2014 to which he added his spouse and daughter as visitors.
4. The Visa was issued for three of them end of October 2014.
5. I proposed to her last week and she said "YES" ;D
6. We decided to get married on 1st week of December, 2014
7. Planning to apply for Spousal PR during 2nd or 3rd week December, 2014.

So, my question here is : Since she already has a Visitor visa, can she come to Canada while her PR application is in process ? Would there be a problem while entering Canada as she has obtained her Visitor Visa along with his Dad's Visa ?

As long as your girlfriend has a valid visitor visa to Canada, she can enter while PR is in process. She will still have to show strong ties or proof that she will return to India at customs, (ie return tickets).

Firstly.... many congrats!....

As long as the visa is in her name and there isn't a requirement for her to enter with her dad it should b ok.... but u should mention that she has a visitor visa in your spousal application...

I am only worried what would happen at immigration, as She thought she would be accompanying her dad. But now, she will be entering Canada as my Spouse. I spoke to a lawyer and I was told that this would be a risk as the Immigration officer might think it was a misrepresentation for obtaining her Visitor Visa. But, She has genuinely obtained her Visitor Visa!

Any thoughts!?

It is not misrepresentation since she was not married at the time of her submitting her visa. It is no difference from my wife. She has gotten her visa as a single person and got married after she got her visa. No issues with customs.

Hello Screech339,

I have a similar situation with my wife. She received her visitor visa for 5 years multiple entry prior to us getting married. I am planning on bringing her for a visit to Canada and I would like for her to be able to stay for the full 6 months allotted but have yet to begin the sponsorship process. My question is can I go through non-Canadian customs with her even though I am a Canadian citizen? If so would there be any reason that the IO would deny her entry? I have purchased a return ticket for her as she needs to go back for family reasons.

I have traveled internationally by plane 5 times in the past and each time I came to Canada customs, I never saw a "Canadian" customs line and a "foreign national" customs. Unless it is something recently added, you will likely be going to the same customs line everyone goes to, canadians and foreign nationals. So both you and your wife will be at the customs booth together.
