Hi Friends need an urgent suggestion,

I will be leaving for India within days and my workpermit expiration date is Oct 31. I am planning to apply for BOWP while i am in Canada and my wife would receive the BOWP documents while she is here. My main concern is

1) if i have been issued the BOWP would my previous workperit will be cancelled or it would be valid till Oct.
2) If its cancelled can i come to Canada on the BOWP workpermit. Will the immigration officer will allow me to enter Canada from the airport.
3) If my old workpermit is not cancelled then also can i travel to Canada as i am on a closed workpermit and working with the same employer. Will they rise the question as your workpermit is valid till Oct.

Please advise.

Thanks for the help.

If you are issued a new WP, your old WP becomes invalid and useless.
2) If its cancelled can i come to Canada on the BOWP workpermit. Will the immigration officer will allow me to enter Canada from the airport.
You will need to have the BOWP with you to enter Canada, along with a valid TRV. Your wife might have to send it to your address in India.
3) If my old workpermit is not cancelled then also can i travel to Canada as i am on a closed workpermit and working with the same employer. Will they rise the question as your workpermit is valid till Oct.
They might just remind you that your WP is expiring and you might have to either leave Canada or apply for PR. Other than that, they will let you enter Canada.

Please advise.

Thanks for the help.

Work Permit is not a travel document. Do you have a valid TRV? Are you visa exempt?

maniac2403 Thanks for the response. I think its better to apply after coming from the trip, as i don't have the TRV.

I am not from Visa exempt country and i dont have the TRV. Thanks

One of the criteria for a BOWP to be approved is that the applicant must be in Canada. it is best that wait until you return to Canada to apply for your BOWP. You have plenty of time.

Thank you Hope1957 for your valuable advise. Will apply after coming from the trip.

You don't have a TRV?
I am on implied status as of July 02 and one of the requirements for me to travel in & out of Canada is to have a valid TRV.

I had called CIC call center previously to ask the same questions as wanted to know if I can apply and go for vacations.

The lady told me that even if they issue a new work permit when I'm out of the country, my previous work permit will still be valid as long as it has not expired.

Correct me if I'm wrong seniors.

WP & TRV are 2 different things.
WP - for you to work here in Canada,
while TRV - is the visa you need if you're going in/out of Canada.

My TRV expired 2 weeks before my WP, & I'm still waiting for my BOWP to be approved
in order to apply for a new TRV to go in/out of the country.

Just a heads-up, if you leave Canada while on implied status, you lose implied status. When you return, you may be allowed to enter and wait for your new work permit, but you cannot work until you receive the new work permit.
