My situation is like this But I am already in Canada via Visitor Visa. I applied to TRV last July and Granted 5 years Multiple entry. I am married to a canadian national for 3 years and we have a baby that is canadian citizen. We are Planning to apply for Inland Spousal Sponsorship and apply for OWP at the same time. Visitors Visa can only allow 6mos stay in canada i am already here 2mos now i am confused when to extend my stay here? a month before expiration ?

oohhh this is a very helpful thread. in my situation, can anyone please advice me on what really are the IMPORTANT THINGS TO CONSIDER AND DO with my common law partner (shes PR and im a tourist but on extension visa) so we can satisfy the immigration officer and get approved in my application for openworkpermit soon.
thank you in advance
Most important for that is to fill in the forms & send them off.

Second most is to continue living until you hear back.

Once you apply for PR you can stay indefinitely until your application is processed, no need to extend visitor's visa.

So are you saying my partner - we lived together for 20 months in NZ - could have come here on a tourist visa and applied inland with the OWP? I thought we had thoroughly researched it and that wasn't possible, as the point of inland applications is to keep couples who met in Canada together, and allow the non-canadian partner to continue to work in their current job.
Yes I'm doing this now. Met wife in UK, arrived 2 weeks ago in Canada as a visitor, applied for PR and OWP, now 3-4 months wait for work permit and PR in 12 months hopefully.

Download the common law sponsorship checklist.. Start filling out the forms now. It will give you a chance to act in a way / collect evidence that satisfies CIC that it is a genuine relationship. Things like joint property lease, joint bank account, joint names on car insurance all help.

You can live together if you are legally able to. So you'd have to have legal status in the country. Like I'm a student here in Canada right now, but we applied outland. (US are allowed to do that.) This, of course, is how we got our 1-year cohabitation.

it says it's optional, but DO the statutory declaration of Common-Law. they will request it even though it says it's optional.
