Can I keep working while PR is in process?

Hi guys,

While my PR Common Law application is in process for the 8 months, can I continues to work? I have heard about Implied Status, does this mean I can work until they reach a decision? I will be sending away the application for extension papers with my application.

My main question is...I am on a working holiday program, and my Social Insurance Number expires August 12th, how can I get a new one without a work visa or any VISA? Do they know about Implied Status?

No, once your visa expires you will have to apply for a visitor visa. Unless you are inland application (pr being handled by cpc vegreville) then if you are all ready approved in principle send off and app for an open work permit then you will be able to continue working on implied status.

If your file is processed Outland or your inland app hasn't gotten to AIP stage yet you won't get another work permit so u need to change to become a visitor so you don't become out of status

Sorry, I don't understand. I am applying form within Canada, so should I send in an application to extend my work permit and not an application for a visitor visa?

if you're on holiday working visa (BUNAC) you cant extend it you will have to apply to remain here as a visitor. But once first stage of approval is complete (approved in principle) this is when your sponsor recieves a letter saying they are eiligable to sponsor you, you can apply for an open work permit. If you have this letter apply for an open work permit, if you do not have this letter you cant extend the bunac. If you sent a work permit app without AIP it will get refused and you will then have to apply for restoration of status as a visitor.

So to summize if your sponsor has not recieved first stage of approval you will have to become a visitor, if your sponsor has recieved the approval you are eligable for an open work permit

So how long does the first stage approval take? So I just have to stay at home and do nothing while this is happening?

It takes 7-8 months to get to first stage approval so, yeah, basically until you are successfully assessed for first stage, you have to just stay home and do nothing - at least as far as working is concerned.

Is there any particular reason that you are applying inland? Which country are you from? Some embassies are able to finalize outland applications in less time than it takes Vegreville to assess just the first stage for an inland ap. You would still have to apply to extend your status/change your conditions - and you'd only be able to stay as a visitor - but with proof of qualification to apply for PR as a spouse/partner, it's not hard to be approved and there's a good chance (depending on where you're from) that the PR ap could be approved before CPC-V would get you Approval in Principle inland . . . and then you'd be working again.

Common law app though, higher chance of interview depending on the country of origin. Although they might waive it if there's adequate proof. If you do go Outland (and there's nothing wrong with that) make sure all the proof of relationship documents is done meticulously, think of it like you're the officer. That way there's a considerably less chance of them asking for an interview. Which would mean you have to fly home to attend it. The likleyhood of it happeneing if your application is well presented is slim. So don't worry if you go this route, just make sure you are thourough
