Hello there,

My partner and I have decided to apply for PR application in Canada after we fly back to Vancouver in October but when I go through the checklist and have a question.

I read “ to apply under the spouse and common law partner in Canada class, you must be living in Canada.”
Does that mean I need to live in Canada for 12 months?
Or is my case( we live in the UK for a year) okay to apply for in Canada class after we move back ? Or as long as we live together for a year, it doesn’t matter which class we pick to apply.

Thank you for your help.

If you want to apply through the "in Canada" / inland stream, both of you need to be physically in Canada. No - you don't need to live in Canada for 12 months. You must have lived together for 12 months continuously but that can be anywhere.

The intention of the in-Canada stream is that you both be in Canada for the duration of the PR process (not as prisoners, but absences should be of the holiday/family visit type rather than long stints away. The pre-qualifying 12 months together could take place anywhere.
