Can I apply to restore as a visitor and spouse open work permit at the same time?

I'm currently out of status before my study permit expired (but within the 90-day window). I plan to apply for restoration of status as a visitor.

I don't think I can apply for PGWP because I may not qualify the full-time study requirement. My spouse holds a open work permit in Canada. Can I apply for restoration of status and spouse open work permit at the same time? Or do I have to wait until I get approved for the restoration first?

P.S. is it difficult to get approved for restoration application?

What kind of open work permit do you hold? Does your spouse hold an open work permit based on your study permit? If so, you unfortunately don't qualify for a SOWP.

You can restore your status to visitor.

I was also in your situation but I applied to extend my stay as a visitor before my study permit expired. I’m not sure about wether you can restore status as a student (your original status) or restore it as a visitor. But regardless, you should not apply for the SWOP until you get your status restored.

I would suggest restoring your status and once approved, apply for your SWOP or get it via flagpoling.

1. You need valid status to apply for a SOWP as a worker. You don't, so you have to restore as a visitor and then apply for the SOWP.

My friend was going to restore status as a visitor but when she called cic, they said she could just restore as a worker since she qualifies for a SOWP it would cost her 455$ 200 restoration 100 open work permit fee and 155 work permit fee

Is a requirement of sowp that you must have valid status as well?? Where can we find this, all our research pointed that the spouse had to be fulltime in school as it's a study permit holder???? And also prove common law??

I think, for an open work permit, you will need to wait until your status is restored. I really don't understand if it is necessary to have a valid status for SOWP

A requirement for SOWP is that either you or your spouse have a valid work or study permit, so makes sense if that's not a requirement
