Is this possible if my common law application be refused ? As I think my
correct category in conjugal. Can I apply straight away ?

If I recall correctly, you should be able to apply at common law now that you have a year of cohabitation. You do have a year of cohabitation now, right?
 
No Profiler, she and my younger kid is still in Manila and me and my older
son is here, we just go back there for holidays.
 
Our cohabitation was in 1997 to 2004 and got separated but continue to support
them.

It's possible to file conjugal, but generally speaking, you have to prove why you cannot live with your partner for a year to establish common law. Is there a reason she cannot come here (with the younger kid), or you go there (with your son) to live together for a year?

Even if you do not have proof that you cohabited for at least one year during those years, you are still common-law since the relationship has continued.

Applying as a conjugal partner would be a form of misrepresentation.

They are not common-law. The relationship was over for many years and since reuniting, they have been living in separate countries.

No - not possible unfortunately. You face no immigration barriers to becoming common law / getting married.
 
I was married before but lost communication with her from 1990 and in 2004
she told me she was in Canada and sponsored me , but things did not go well
we mutually separated in 2011 and this is the time I got back to my common law , I was officially divorced in 2015 here in Canada and there is no divorce in the
Philippines

There is nothing stopping you from getting married in a third country or you from moving to Manila to establish one year common law status. This is why you don't qualify for conjugal PR sponsorship.

Conjugal is only for those who cannot get together to establish common law or get married at all, ever. As long as you have options to become common law and / or marriage, you don't qualify for conjugal.
 
That is big financial burden for me as I am the only one working
and I have been supporting her half of my salary goes to Manila to pay
for everything
