Hello

I am just confuse about the situation and needed suggestions. I am a Canadian citizen. Have decent job and income. I sponsored my husband but he never had gone for his interview. Cic refuse his immigration. Now we are separated for almost 2 years.Have not filed legal divorce paper yet. I am a single now. My sister and brother in law are here on a student visa. they are well qualified to apply for immigration on their own. Now i would like to sponsor my brother and his family. Any possibilities that i can sponsor my brother and his family.. I read in cic about sponsoring other family member.

Thanks Much

Are either of your parents still alive?

If you have no family members who are already citizens or PRs of Canada (i.e. no siblings, uncles, aunts, children, nieces, nephews) - then you may be able to sponsor your brother. However I think CIC would state you have to formally divorce your husband first. I suspect they won't accept your brother's application while you are only separated from your husband.

My sister and brother in law recently applied for immigration a couple of weeks ago under AINP category. It will take long for their application. i still can sponsor my brother rite?

As soon as your sister gets PR status, then you will have family in Canada who's a PR so if your brother's app was still processing at that time it would most likely be cancelled since you would no longer be eligible as a "lonely Canadian". You would need to ensure that your brother's app was completely approved before your sister got PR.

As long as you get divorced before you submit the application - yes.
