Hi all,

I am new here. My boyfriend Ray entered the United States without inspection a few years ago and was taken by ICE on 8/27. He was granted voluntary departure, meaning he will be returning to Peru without deportation on his record. However, I know that Canada will find out about this, as the two countries share immigration information. Ray pays taxes, works, and has no criminal record of the sort. When he lands in Peru, he will find out how long he is barred from the U.S. for.

I (a U.S. citizen) and thinking of relocating to Canada with Ray to be together. I am qualified for Express Entry, and I want Ray to possibly come through a LMIA since he works in construction and carpentry. However, I am in fear that any visa, whether that be an LMIA or a visitor's visa for us to temporarily visit, will be denied due to his voluntary departure. If anyone is able to provide me with any help or information, that would be great. Thank you!
 
What is your CRS score and NOC? Is your NOC in demand or fluent in French? If you know you will be invited then may be easier to marry.

Getting an approved LMIA may be difficult as it should be high wage with eligible employer. Does he have an approved LMIA to apply for a closed work permit? Employer has to prove no Canadian has the education, work experience and language skills to do the job.

In the meantime, both of you should take language tests and get ECAs.

The chances of a temporary visa being approved for him are going to be extremely low. If you can get PR approved, that will be different. However anything like a work permit or study permit or TRV is going to be extremely unlikely given his history in the US.

At a minimum, he would want to live in Peru for a year or two to establish ties there before attempting to apply for any sort of temporary visa to Canada.
