Hi,

My fiancé/boyfriend, Ray, was detained by ICE on 8/27. He was granted voluntary departure by an immigration judge on 9/16. He has no criminal record, pays taxes, and has worked in the US. He EWI (entered without inspection) in the U.S., unfortunately. Since he is going back to his home country (Peru), we are thinking of moving to Canada (I am from New York). He is a construction/carpentry worker, and his family owns a business in Peru. We are looking to get him into Canada through a work visa and me through Express Entry, since I qualify.

I was wondering, will his voluntary departure from the U.S. result in a future Canadian visa denial? I know that the U.S. and Canada share immigration information. When he is in Peru, he will find out how long he is barred from the U.S. It is most likely 3 to 5 years. Please let me know. I am not looking for judgment, just some helpful answers. I also know he as family in Canada, they are elderly, but they are residents. Thank you!

He won't be inadmissible but he will need to disclose all that when applying. Otherwise he will surely become inadmissible for misrepresentation.
