Hi guys, i know that the bowp states that i need to be in Canada in order to apply. I'm currently on vacation, but live in Canada. Does that mean i can't apply for bowp until i get back into Canada? My spouse who i am sponsoring is currently in Canada and his work (post graduate) permit is expiring very soon. We assumed he would be under implied status as soon as we got AOR but not sure if that is really the case. We are trying to figure out our options now, will he need to leave canada until our PR is approved?? Thank you

No, applying for PR does not have any impact on your temporary status. Implied status only exists when a temporary resident (worker, student, visitor) applies to extend the same status, and submits the new application before the old permit expires.

I remember your husband's posts, as I recall you have already been gone from Canada for some time and don't plan to return before July (or until the PR application is processed?). So if I am remembering that correctly, "vacation" isn't really the right word.

He could change his status to visitor and stay in Canada, but of course would not be able to work. He has already indicated that his employer will not apply for the LMIA. It is possible that his leaving Canada would be the best option.

He has left Canada and I am also out of Canada temporarily. I'm due to return shortly before my work permit expires and plan to apply for bowp immediately when I arrive. I'm just wondering if I have to physically be in Canada or just "living in Canada", which I consider I still am as I have kept my housing there and am just out temporarily. Since it's an online application just wondering if I can apply earlier or need to wait til i land

You are supposed to physically be in Canada.
