Hi,

Here is my situation...I work in the US and got my PR almost a year ago.We have a child who was born in the US after I recd my PR cards. Here are a few questions:
1) How do we make him a Canadian PR? Do we apply seperately on his behalf or do we sponsor him?
2) What happens once we move to Canada in next 2 months, Can he stay with us as long as he wants or are there any restrictions?

I would appreciate any valuable suggestions that anyone can give.

Regards,

After you move to Canada, you need to apply to sponsor him for PR. As a US citizen, he can enter Canada as a visitor for up to 6 months and sponsoring children is usually faster than that but if you want to be perfectly legal, if you still haven't got his PR after 5 months, you can apply for his visit status extension.

I would suggest you apply for his PR right now. As legal residents of Canada, you have the right to take your child with you (his being a U.S. citizen helps). Once you start the process from U.S., you should get the whole procedure taken care of in 3-4 months.

A PR has to be in Canada to be able to sponsor. Only a citizen can sponsor from outside Canada.

There is also no automatic right for PR's to take their non-PR children to Canada with them. In this case because the baby is a US citizen and visit visa exempt, there shouldn't be a problem but in cases where babies of PR's are not visit visa exempt, Canadian embassies have often refused babies a visa to go with the parent to Canada to be sponsored.
