Hi everyone,

I am living with my wife in Montreal. She has a Study Permit valid until 2018 and I as her spouse, have an OPW.
My wife is experiencing some serious health issues and she wants to go back to our country during this summer to see our doctor and come back to study on fall.
The problem is, her college is not having vacations this summer and she is supposed to have class during this time.
She would have to cancel her summer classes.

The big question is: Do my OPW becomes invalid in this situation?
We are very concerned about this because we don't want to lose my job and she deserves to go home to treat herself.

Also, we find it very weird that the college is not giving any vacations for 1 year and a half (whole 2016 and beginning of 2017). Is this even legal?

Thanks in advance,
Rodrigo

There's nothing "illegal" about a school program having no summer break. Many programs do have summer breaks. But some are accelerated and don't. It's entirely up to you what program you pick. So your wife was the one who made the choice to take a program with no breaks.

To answer your question, your OWP will be fine. However your wife's study permit may be canceled if she drops out of school for more than 90 days.

Thanks for you answer scylla.

Her winter classes end in the beginning of may and fall classes start on the end of august.
In this case, she would definitely be out for more than 90 days and I would risk losing my OPW, right?
