Hope everyone is enjoying a good day.

I am a citizen of India. I have been living and working in Canada as PR for almost 5 yrs. Recently, I have written my citizenship test (last month), and hoping to receive oath letter for Canadian citizenship soon. I am seriously considering my marriage this year and pondering different options.

I have been talking to a wonderful lady from India lately. I am planning to go ahead with her for my marriage. Can you please share your opinion about the best possible way to sponsor spouse from India for PR application considering my below scenario?

First, my PR card is expiring in November. So, as soon as I receive my oath letter and I get my citizenship certificate, I immediately plan to apply for Canadian passport as well as for India OCI card. Considering the current timelines, it looks like I may not be getting my OCI card until at least December 2015. I plan to visit India once I get my OCI card and then marry my partner.

What is the best way to apply for spousal sponsorship of an India applicant of the below two? If you know of any other way other than the two mentioned below, please suggest.

1) I am thinking of asking my partner in India to apply for a Canada visitor visa first, and bring her back with me to Canada after our marriage and sponsor her PR while she is here in Canada with me. If I go this route, can I apply for her PR as outland? (we give her parents' address on the application). If outland is not a valid option in this scenario, I may apply for inland application.

2) I come back alone after our marriage and sponsor her PR while she is in India, so this will be outland.

Please share your valuable inputs and opinions on this including the processing timelines that you have seen. I do not like to be separated from my partner for long time.

You don't need to be a citizen to sponsor your to be wife . You can apply outland while your wife is visiting Canada . You do not have to put her parents address, it is ok to write your address as hers while she is her as a visitor. You only have one choice to sponsor her and that is through spousal sponsorship.

Assuming then it is ok to apply outland while my partner is visiting Canada with me, can someone please share inputs on these below points?

- If I choose to apply outland while my partner is visiting Canada, would she be able to travel in and out of Canada during the processing of her PR application?

- Can someone please share the processing timelines of an outland PR spousal sponsorship application of an India applicant these days? The official website of CIC says it takes 57 days (assessment of sponsor) + 16 months (assessment of person who is being sponsored) as of today, but I wonder what the timelines are in REALITY?

- What are the approval rates of person applying Canada visitor visa from India while SHE IS NOT YET MARRIED?

So, looks like the best way is to apply for the visitor visa of my Partner first, then get married, bring her back with me here and sponsor PR for her via outland while she is with me here.

Yes while applying outland there is no restriction on the sponsor or the applicant and they can travel freely

The current processing for the first stage is close to 60 days and then after transfer its taking an average 8-9 months for straight forwarded cases. NDVO is currently working on applications received in Sept/Oct 2014.

The main barrier for getting a visit visa is not having/submitting enough proof that the spouse will comeback after the visit; as long as a person can prove that the chances of rejection is less. keep in mind if the visa is rejected you will have to disclose it while applying for her PR.

Ideally if you can get the visit visa before getting married then get married and come back together apply outland would be great; the other way is to get married you come back apply outland and then apply for visit visa and then wait out the period here.
 
For her to get a TRV she has to prove she will leave Canada before her visa expires, so she should think of things that will prove she will return to India. A letter from an employer giving her time off is great; proof of bank accounts, investments, a lease or mortgage or property, enrollment in school, etc. are also good.
Once she is in Canada, yes, you can apply outland while she is visiting you here, and she can travel in and out of Canada. But she can only come back into Canada if she has a visa - so she should apply for a multiple-entry visa. If she has only a single entry visa, she will not be able to leave and come back - to come back, she would have to apply for a new TRV.
