Hello again
Thank you to all who gave me your advice through my exclusion order.
As of June 2024 I left Canada as requested CBSA.
I have resided in my home country mostly. I made an express entry profile and I have a 443 score, I hope for a matching CEC or Trade draw as I would qualify for an ITA.

As of recently I have found a new job opportunity in Alberta, about to approach the interview stage. Yes, I did disclose my exclusion order to said recruiter.
It would be on a francophone work visa and would start in the summer so after June 2025. Which would fall after my 1 year band from Canada.

If I were accepted and offered the job:

Should I still apply for ARC?
Would the new temporary permit even be approved ?
Would I have to expect more screening due to my previous infraction ?
Should I consult a lawyer/consultant to determine the best possible steps forward ?
Should I just wait for my chance with EE?


Has anyone been through a similar situation?

When does your exclusion order officially end?

To avoid triggering the ARC process, you want to make sure you submit the work permit application after your exclusion order ends.

Yes, you can certainly expect more screening of the application due to the exclusion order.

None of us can comment whether the work permit will be approved or not. This will be influenced by why you received the exclusion order.

Your score is too low for CEC. CEC draws are well above 500. You can certainly also wait and hope for a trade occupation draw. I assume your specific trade is on the occupation list.

Yes, CEC draws were above 500 in the past but could fall due to lmia points removal and trade draw for cook which is now included in the trade list.

Ok - so then make sure you don't submit the work permit application until after June 7th.

Agreed CEC scores will drop somewhat however keep on mind that a lot of CEC applicants may have been on open work permits and not relying on the 50 points. For that reason most of us here think the score will remain around or just above 500. Of course only time can tell.

Trade draw for cook sounds like a good path for you from an immigration perspective.

What are the chances my visitor visa is approved ?
My 1 year exclusion would end in June 2025.

It will be up to IRCC. I really can't guess.
 
Ok. And if the visitor visa is refused would this negatively impact my file further ?

It would be another refusal you have to declare.

Recap, had a 2 year work permit then exclusion order that ends June 6th 2025 due to continued work without valid permit. Active EE profile 451 points & my Gf lives in QC.
We are about to submit our spousal sponsorship application to irrc, within Québec.
Are there any extra documents that required to be submitted with our application or suggested ?
Are there any methods to the process that would speed things up or help avoid delays ?

You're waiting until after June 6th to submit the application, yes?

Assuming so, no extra documents but make sure you answer all questions correctly in the application, including those that indicate if you have ever been refused a visa, etc. In your personal history section, make sure you are forthcoming about the periods of time you were in Canada without status and also the illegal work. If you are including an LOE, you can provide a short explanation of this history there too.

What would speed up the application is having your sponsoring spouse leave Quebec. As a Quebec applicant, you are in for an extremely long wait.

We will continue with the Outland in QC app at this time.

But, if we do decide to change province, would this not look suspicious?

She moves to Ontario and then we submit the application. What would they look for to determine the authenticity of the relocation ?

If you want to do the province switch, the advice would be to do it before the application is submitted. If you do it after, IRCC may still continue to process the application under the Quebec caps. The results on switching provinces after the application has been submitted have been very mixed.

In terms of evidence she has relocated to Ontario. Obviously her primary residence would need to change to Ontario and she would need to move over to Ontario for things like health care coverage, her driver's license, etc. Her 2025 taxes will need to be filed as an Ontario resident. She would want to make sure she updates her primary residence to Ontario with her employer, bank, etc. Basically it needs to be a real move out of province. She would need to then maintain this until your application is approved (currently 3 years).
