Hi all,

Just wondering, will CIC hack e-mail accounts during the background check? I'm not asking because I have anything to hide, but I was curious as to how much power they have to delve into the check.

Anyone?

I would assume that would be considered an invasion of privacy, so no?
 
I think companies such as FB, Gmail etc can show information about you to police etc.. but I am pretty sure they would need some kind of warrant. So if they would find something in your background that makes them believe checking these things is important then perhaps they can... and if they find something so strange that they want to see some messages then I guess that's fine.. I'd rather have that done than to have some terrorist enter Canada, or someone that is just doing marriage fraud, those people completely deserve it. They could probably filter through emails looking for specific words I suppose.

What exactly do they do for the background check? Contact RCMP to see if the sponsor has any criminal record? When the answer comes back "No", what's left to check? Or is the background check more for the sponsored person?

All I can speak about is my application... because that's what I know.... My wife had to submit a police record check along with our application. This shows that she has no criminal record.. If they want to contact her country and ask for more details I suppose that they could.. but this legal document should provide all the proof they need. Hope that helps. I did not need to hand in any Criminal record check... however, that may be because they can easily do that in this country (get proof) and some countries might be more difficult.

go that far...plus once they approve you as a sponsor, the background checks are mostly for the applicant, not the sponsor. I think they mostly want to know your not on welfare or undischarged bankrupt. or a murderer lol

No that's illegal. And the background check is on your wife not you.

No they will not hack into your email accounts. They will not do anything that is an invasion of privacy under the law, nothing illegal. But they WILL check with any police, interpol, FBI, foreign law enforcement etc looking for criminal records, ties to criminal activity or terrorism etc. Anything where the applicant may have misrepresented themselves. Anything related to scams. Former immigration frauds or marriage frauds etc etc etc. They are looking for ANYTHING that suggests the applicant wants to come to Canada for a reason other than to be with their spouses in a legitimate marriage. They have the power to contact any foreign government agency, law enforcement etc, and make enquiries about any information that is not protected due to privacy etc, depending on each individual countries laws. So they can and will do anything within their power that the laws of Canada and the laws of the country of the applicant allow.
 
They can go as far as they need to based on what they find or places you've visited. An immigration lawyer told me that CSIS(Canadian Security Intelligence Service) is involved in background and security checks. They usually have agents in other countries who can do the leg work to verify information and can call applicants for "security interviews" if they uncover something. It's nothing to worry about if you are not involved in terrorrism, etc.
