hi everyone well I have returned to the forum after almost 2 years because my husband was denied with the first app and then i decided to go to tunisia and live with him for 17 months. so now am starting my second round with immigration. anyone have any updates on how the visa offices are with tunisians coming to canada???

Hi there since you a new person with the immigration system, I believed you have prepared yourself enough to convince them this time around. what matter is the quality and quantity of your file need to convincing to the visa offficer who will open your application to process it. Since you did it for the first time you know what they want from you. I have something to share with you. There was one day one of immigration officer was saying that:" when we see a package arriving at our office we always guess at 100% that there are bunch of lies and fraudulant documents in side. it's up to the package to convince us and meet all the CIC requirements" So that is what I can tell you.

If you appealed and lost the appeal, it will be more difficult. If you did not appeal the refusal, and just went to Tunisia to live with him, the second application should be easier. You now have lots of evidence that the relationship is genuine - 17 months worth.
Even if you did lose an appeal, 17 months of living together may be considered enough new evidence for you to succeed this time.
 
my first appeal was denied but instead of doing the full appeal my husband told me to just move there with him. then after 17 months i was in the position of having to return to canada to take care of my 83 year old mother who has demensia. so now am just going to file it again.
 
So you had an ADR?
With a failed appeal, it is more difficult. The visa officers will often reject a new application because of res judicata, which means 'it has already been decided.' If appealed, the judge usually will reject it for the same reason. However, if you have significant new evidence that was not available at the time of the first application or appeal, you can be successful.
The types of new evidence that have worked have been 1. a baby, and 2. the sponsor going to live with the applicant for a significant period of time. 17 months is a good length, so make sure you have a lot of evidence of your time together.
 
yes i had my adr but the wanted to do a full session because they wanted to talk to my husband but instead i moved there and before i left i withdrew my app. they didnt believe our marriage was genuine because of the age difference and that was about all i got out of what the said. so i withdrew and went there with him and his family and friends. together over 5 years now and married 4 so come on and 17 months of living with him in his country. sometimes i really wonder what these people think? just because i am 18 yrs older they think i cant have a younger man actually fall in love with me. this infuriates me. >:(
 
my first app was full of proof, pics, friends letters, letter from my mla, and 100 emails, phone records etc so i had more than enough proof but yet they denied him. so am praying that this time when i file they will realize that we are together and that nothing will stop that. hoping to get the rest of my papers and file next month

Hello sheri22, I pray that you will be successful at round 2 and it seems as though you have lots of additional proof. I am so sorry your mom is not well and that you have to be put through all of this stress from immigration. Many blessings for your future happiness and stay strong in your love and marriage.

Hi everyone, well I talked to a lawyer and I guess I made the right choice by withdrawing before my full appeal and going to live with my husband for the 17 months. :) from what they say I have now secured our marriage and that by doing this I have the proof that they were looking for. So heres hoping that this time things will go fast and smoothly. 5 years is way to long to be without my husband.

I've also been with my husband for five years, married for three, we would have been married for four but I didn't have a crminal records check for the Cambodian govt (the embassy was unaware I needed it) so we had to wait an extra year to marry and I think that year was helpful for our application. My husband is 17 yrs younger than me and I was terrified about that. Seems to be not so big of a deal the other way around. It was very much mentioned in the notes but fortunately for us they gave it the BF (bonafide) stamp or I would be moving there too. I think you'll get the hoped for result this time around. I really hope it goes smoothly and swiftly. All the best.
 
:D thanx toutesweet I pray this time things go smoothly because I have no other choices at this time :( I have to be in Canada because of my elderly mom and have to be apart from my husband yet again :( . after this many years and all the stress we have been put through they should really see that no matter what life throws at us we are together and will be no matter what...
 
hello there

iam tunisian and am sponsering my tunisian husband we got married in sep 2013 sent my application in the end of october 2013 and it was recieved on mid november 2013. i was aproved by mid december and then my husband's file was tranferred to paris by end of dec and few days later they recieved his medical examx.

we just recieved an email from them asking his t take his passport and get it stemped.
so in a total of 6 months we got everything
