Baby born to PR holders outside Canada

My wife, 2 daughters and myself, became Canadian Permanent Residents on the 5th July 2011. My wife is now expecting our third child and we were wondering needs to do be done to get the baby a visa, what are the best suggestions or advice available to guide us? What will the baby's status be?

The baby does not get any status because of your PR. The baby will be of whatever citizenship it gains either from being born in Dubai or from being your child. You will now have to sponsor the baby for PR. In order to do this, you must be living in Canada.

When you are ready to move to Canada, if the baby has a passport that is visa exempt to Canada, you just take it with you and sponsor it after you arrive.

If the baby needs a visa, you can try applying for a TRV for it. This is often denied because the intention for the baby is not to be staying in Canada temporarily. You can then try applying for a TRP, a different type of permit for special scenarios. Sometimes granted to parents&babies in this position. If you get the TRV or TRP, continue to Canada and apply to sponsor after you have arrived.

If you can not get a TRV or a TRP, the one last option is that one of you, the parents goes to Canada alone or with the other children who are already PR and applies to sponsor the baby. The other parent has to wait and take care of the baby until the PR is through.

Another option would be to move to Canada before the baby is born. Settle in a province with 1st day health care and the baby will be born a citizen.
