Hello all,
Here is the deal..
My AUS wife is waiting for her Permanent Residency application to be accepted. She desperately wants to return to AUS to visit her teenage sons.
Is she allowed to leave Canada for a short time while here application is being processed or does she have to wait until she secures P/R status?
Thank you very much in advance

How did she apply for PR? Inland or outland?

You're in a tough spot. Chances are extremely high that she would be allowed back into Canada on her return. However there's always some small chance she could be refused - in which case your sponsorship application would be effectively abandoned and you would have to start again from scratch.

In short - it should be fine but there are no guarantees. So this comes down to a decision about how risk adverse you are. If you want to play it 100% safe then she needs to remain in Canada until she has PR.

1. Did she apply for sponsorship while she was in or out of status?

2. What stage is her sponsorship - does she have an Approval In Principle?

3. What does she do currently in Canada - work/ study etc?

4. What is the possibility of her sons travelling to Canada instead?
